From the novels it seems to be possible to hold both positions at once. Kellen was already a Legate when he attended the Academy at the start of Golden Son and becomes a Praetor after graduation. Apollonius is referred to as both a Legate and an Imperator. Pax mentions Harnassus is an ArchLegate in Iron Gold but is an Imperator in Dark Age, and so on.
It does make sense, as he seems to be the leader of the Mercenary Company. I enjoy that it gives us some dating for likely Iron Rains that Spiridon participated in, considering both are Martians with martial histories.

I like how this really emphasizes how despite the myth around him, he was always as ruthless as any other gold. He was just strategic about it, especially in regards too angling himself to be on the right side of moral legitimacy. Really shows why the Jackal decided his chosen method for execution, no point in offering mercy to a guy that would do stuff like this.
